The building: State Fire Marshal Modular Building Program

Tennessee regulates modular construction through the Department of Commerce and Insurance, State Fire Marshal's Office:

  • A Construction Inspection Agency (CIA) inspects the unit on the production line and affixes a Tennessee Modular Building Unit Certification Label before it ships.
  • Manufacturers, dealers and installers must be licensed and bonded in Tennessee.
  • Your local jurisdiction permits the site work — foundation, utilities, zoning — without re-reviewing the structure.

ADUs: Nashville leads, others vary

Tennessee has no statewide ADU law, but Nashville changed dramatically in late 2025:

  • BL2025-1007 makes DADUs by-right in most residential areas of the Urban Services District (no overlay needed) and adds a DADU overlay option in the General Services District.
  • Size: lesser of 1,000 sq ft or 35% of the main home; generally two stories; 5-foot rear/side setbacks.
  • Knoxville, Chattanooga, Sevier County — own rules; confirm locally.

The site: mountains, wind, and Memphis seismic

  • East TN (Smokies). Steep lots and light mountain snow; helical-pile foundations are common.
  • Middle TN. Mild; wind and tornado considerations.
  • West TN (Memphis). The New Madrid Seismic Zone — seismic design is a real factor here.

Realistic timeline

  • Factory: build + CIA line inspection + certification label, in parallel with site work.
  • Local: a site/building permit for foundation and utilities, plus the local ADU/zoning review (by-right in much of Nashville).
